1. Platform Overview
Indian-Properties acts as an intermediary connecting buyers, sellers, tenants, owners, brokers, and builders.
We do not participate in any actual transactions between parties and are not a party to any agreement between users.
2. Eligibility
You must be at least 18 years of age and possess the legal authority to enter into this agreement. Use by minors is strictly prohibited except under direct parental supervision.
3. User Account and Security
- You are responsible for maintaining the confidentiality of your login credentials.
- Any activity occurring under your account is your sole responsibility.
- You agree to notify us immediately of any unauthorized use of your account.
4. Submission and Administration of Listings
- Accuracy: You represent that all property information, photos, and documents uploaded are accurate and belong to you or you have the legal right to list them.
- Prohibited Content: You shall not upload content that is defamatory, obscene, promotes discrimination based on religion, caste, or community, or violates any law.
- Verification: The Platform reserves the right to verify, edit, or delete any listing that violates our policy or appears suspicious.
- License: By posting content, you grant Indian-Properties a perpetual, royalty-free, worldwide license to use, display, and distribute such content.
5. Payment Terms
- Service Fees: Certain services, including Featured Listings, are paid. Fees are non-refundable unless specified otherwise.
- Third-Party Gateways: Payments are processed via 3rd-party partners. Indian-Properties is not liable for technical failures or data breaches at the payment gateway level.
- Taxes: All fees are exclusive of applicable taxes, including GST, which will be charged as per government norms.
6. Intellectual Property Rights
All logos, trademarks, software, and content, excluding user-generated content, on the Platform are the exclusive property of Indian-Properties.
Unauthorized copying or scraping of data using bots is strictly prohibited.
7. Limitation of Liability
- As-Is Basis: The Platform is provided on an as-is and as-available basis. We do not guarantee the accuracy of property details or the intent of users.
- Intermediary Role: We are not responsible for any financial loss, property damage, or legal disputes arising from transactions initiated through the Platform.
- Third-Party Links: We are not liable for the content or privacy practices of 3rd-party websites linked on our Platform.
8. Indemnification
You agree to indemnify and hold harmless Indian-Properties and its officers from any claims, damages, or legal fees resulting from:
- Your violation of these Terms.
- Any property listing or content you post.
- Your interaction with other users.
9. Termination
The Platform reserves the right to suspend or terminate your account without prior notice if you:
- Violate these Terms.
- Provide false information.
- Engage in fraudulent or spam activity.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Delhi.
